DWI Fact #4: What happens during a DWI stop? Most people are stopped for DWI in the evening or early morning hours. If you are driving during that time and you get pulled over by the police, there is a good chance that you will be asked to perform tests and provide a breath sample. When stopped, remember that the officer can only detain you for as long as it takes to complete the purpose of the stop. You do not have to answer any questions. In fact, answering questions may inadvertently cause the officer to suspect you are intoxicated. Once the officer has probable cause to believe you have been driving under the influence of alcohol, he or she has enough to arrest you. You will likely be video and audio taped during the investigation and the entire ride to jail. What you say, how you act, and what you do may ultimately be shown to a judge and/or jury, so be on your best behavior! Always be polite, don’t use profanity, don’t beg, don’t cry, don’t act hysterical, and don’t talk or fall asleep in the police car! If you get arrested, call an attorney at the first opportunity.
